A-M Law‘s Joe Mierzejewski Successful At Trial
Joe Mierzejewski defended a PIP case in a trial in Macomb County Circuit Court before Judge Peter Maceroni. Prior to trial, Plaintiff sought replacement services and extensive medical bills for treatment based on what appeared to be a minor injury on the day of the accident. Plaintiff was apparently referred to a chiropractor by an attorney, and the chiropractor then directed all of Plaintiff’s additional care. Plaintiff had extensive chiropractic manipulative therapy, orthopedic examinations, treatment at a pain clinic, including epidural injections, two series of MRIs, was prescribed a TENS unit, and had numerous prescriptions for physical therapy.
The Defendant insurance company had paid tens of thousands of dollars in medical and replacement services benefits prior to IMEs by a chiropractor and PM&R physician. Benefits were discontinued following the exams. Plaintiff continued to treat and sought over $80,000 in unpaid medical expenses.
After deliberations, the jury unanimously returned an 8-0 verdict of no cause for action, finding that the Plaintiff had not incurred any allowable expenses for which Defendant was liable.
The Defendant insurance company is considering post-trial motions for case evaluation sanctions and MCL 500.3148 attorney fees.
